Control of the police focusing on crime with elements of abuse of authority

Abstract:

Trestná činnost v podobě zneužití pravomoci je závažným problémem každého demokratického státu, který dbá ochrany práv a svobod. V případě, že se takového protiprávního jednání dopouští policisté, kteří sami dohlíží nad dodržováním platných zákonných norem, jde o velmi závažnou trestnou činnost. Účinným prvkem v oblasti předcházení a potírání této kriminální činnosti je důsledný a správně nastavený systém kontroly. Techniky a druhy kontrol činnosti policie vymezuje právní úprava, stejně jako působnost vnitřních, vnějších i specializovaných subjektů její kontroly. Zákon také striktně vymezuje formy jednání, která naplňují skutkovou podstatu trestného činu zneužití pravomoci úřední osoby dle ustanovení § 329 trestního zákoníku. Statistiky dokladují, které z těchto forem převažují a jaké jsou typické znaky pachatelů. O druhu trestné činnosti rozhoduje nejen věk a služební zařazení, ale také délka služebního poměru a vzdělání.

Abstract:

Criminal activity in the form of abuse of authority is a serious problem for any democratic state that ensures the protection of rights and freedoms. In the event that such an unlawful conduct is committed by police officers who themselves oversee compliance with the applicable legal standards, it is a very serious crime. An effective element in the area of preventing and combating this criminal activity is a consistent and properly set control system. The techniques and types of inspections of the police are defined by the legislation, as well as the competence of internal, external and specialized entities of its inspection. The Act also strictly defines the forms of conduct that fulfills the facts of the crime of abuse of the authority of an official pursuant to Section 329 of the Criminal Code. Statistics demonstrate which of these forms prevail and what are the typical features of the perpetrators. The type of crime is decided not only by age and service classification, but also by the length of service and education.
