Abstract:

Cílem této diplomové práce je obecně charakterizovat průběh trestního řízení a obhajoby v trestním řízení v českém právním systému, dále představit ucelené informace o postavení obhájce v trestním řízení, souhrnně popsat a analyzovat problematiku obhajoby v trestním řízení, ve které hlavní postavení má osoba obviněného spolu s osobou obhájce, jehož postavení- práva a povinnosti jsou neodmyslitelně spjati s postavením obviněného. Zpracovávané téma vymezuje práva a povinnosti obhajoby, osoby, proti které je vedeno trestní řízení z rozličných hledisek. Nalézáme zde popsány možnosti obhajoby z pohledu obhájce, osoby s jinými obhajovacími právy, zákonného zástupce.

Abstract:

I decided to create a general description of the defence in criminal proceeding in the Czech republic together with the description of competences and responsibilities of both sides, the advocate and the accused person. I defined the rights and responsibilities of advocate and the person under criminal trial. In order to this I also described the position of the suspect, the sufferer and the accused during the trial. I also wrote about the courts, their history, rights and responsibilities. At the end of my work I described the difference between Czech and foreign law system.My main goal was to create a complete characteristics of the criminal trial, which belongs to Czech law system.
