Abstract:

Autorka se v diplomové práci zabývá aktivním a pasivním volebním právem občanů Evropské unie trvale pobývajících v jiném členském státě, než jehož jsou státními příslušníky, ve volbách do Evropského parlamentu a do místních zastupitelstev. Cílem práce je komplexní zhodnocení právního postavení jednotlivce, jehož podoba vychází z unijní úpravy. Ta umožňuje členským státům přizpůsobit národní právní úpravu vlastním ústavním zvyklostem za dodržení zásady rovnosti a zásady zákazu diskriminace dle státní příslušnosti, jejichž projevem je zaručení rovného přístupu k volebním právům za stejných podmínek, jaké mají občané státu trvalého pobytu, svoboda volby místa výkonu volebního práva a povinnost členských států včas a vhodným způsobem informovat o možnosti a způsobu výkonu volebního práva, přičemž však za velmi problematickou lze považovat možnost členských států nepoužít ustanovení o rovném zacházení v případě, že počet občanů jiných členských států v dotčeném státě přesáhne 20% hranici.

Abstract:

This diploma thesis is focused on the right of the citizens of the European Union residing in an EU country of which they are not nationals to vote and to stand as a candidate in European Parliament elections and in municipal elections in that country. The main aim of the thesis is to comprehensively analyze legal status of an individual which is based on the European Union legislation. Provisions of the European law enable member states to adapt national legislation to their own constitutional customs while the principle of equality and non-discrimination on the basis of the citizenship must be fulfiled. These principles are demonstrated by the acces to the electoral rights under the same conditions as nationals of the state of residence, the freedom of choice whether to excercise these rights in the state of origin or in the state of residence and member states duty to inform about the excercise of the electoral rights accordingly and in time. In this context, the possibility of derogations of equal treatment provisions in case of specific situation seems rather problematic while the specific situation is defined as such that the number of other member states citizens in affected state exceeds 20%.
