The Law of the International Treaties and the International Treaty as a Primary Source of the Contemporary Public International Law and its Relationship to the Custom of International Law.

Abstract:

Diplomová práce je tematicky zaměřena na dílčí oblast mezinárodního práva veřejného, tvořící celé právní odvětví: smluvní právo (právo mezinárodních smluv). Cílem práce je objasnit roli mezinárodní smlouvy v odvětví mezinárodního práva veřejného. Těžištěm práce je zevrubně charakterizovat mezinárodní smlouvu jakožto primární pramen soudobého mezinárodního práva veřejného, formulovat primární prameny práva v předmětné oblasti či v neposlední řadě zařadit mezinárodní smlouvu do pomyslné hierarchie pramenů mezinárodního práva. Ambicí práce je analyzovat vztah mezinárodní smlouvy k dalšímu základnímu pramenu mezinárodního práva, respektive interpretovat poměr mezinárodní smlouvy a mezinárodněprávního obyčeje prostřednictvím vybraných případů rozhodovaných Mezinárodním soudním dvorem.

Abstract:

The diploma thesis is thematically focused on a sub-field of public international law, which forms the entire legal branch: contract law (Law of Treaties). The aim of this thesis is to clarify the role of the international treaty in the field of public international law. The focus of the work is to thoroughly characterize the international treaty as the primary source of contemporary public international law, to formulate the primary sources of law in the issued area or, last but not least, to include the international treaty in the imaginary hierarchy of sources of international law. The ambition of the work is to analyze the relationship of an international treaty to another basic source of international law, respectively to interpret the relationship between an international treaty and international legal custom through selected cases judged by the International Court of Justice.
