Abstract:

Diplomová práce je věnována problematice insolvence, neboť jsem přesvědčen,že v podmínkách tržní ekonomiky je znalost jejích aspektů důležitá pro všechny účastníky trhu. Hypoteticky lze konstatovat, že na základě studia dostupné literatury a také realizace insolvence v praxi bude sestaven návod pro postup jednotlivých subjektů v insolvenčním řízení. Pomocí finanční analýzy bylo poté u zvoleného podniku identifikováno jako příčina jeho úpadku především chybné strategické rozhodnutí na pozadí globální ekonomické krize. Na základě zjištěných poznatků byla navržena konkrétní opatření pro zlepšení realizace insolvence v praxi, zejména opětovné zavedení povinnosti dlužníka podnikatele podat na sebe insolvenční návrh v případě předlužení a také zvýšení dohledové činnosti insolvenčních soudů ve věci pokynů zajištěných věřitelů při zpeněžení majetkové podstaty.

Abstract:

The master`s thesis is dedicated to issues of insolvency, because I`m convinced, that in conditions of market economy is the knowledge of this aspects important for all its participants. Hypothetically can be stated, that on the basis of studies of available literature and realization of insolvency in practice will be complicated the instructions for practices of particular subjects in the insolvency proceeding. After it was by the help of financial analysis identified as the possible cause of the chosen company bankruptcy especially the wrong strategy decision against a background of global economics crisis. On the basis of the ascertained knowledge was proposed the concrete measures to improve the realization of insolvency in practice, primarily reimplementation of debtor’s duty to submit the insolvency proposal on himself in the event of his over-indebtedness and also increase of the insolvency courts surveillance activities in the affairs of the secured creditor’s instructions during realization of assets.
