Abstract:

Práce se zabývá ochranou osobních údajů, nejenom v rámci právního systému a společenské praxe České republiky, ale také na úrovni Schengenského prostoru. Nejprve se zabývá vymezením pojmu osobní údaje, a dále charakteristikou úkolů a systémem práce ÚOOÚ. Dále je komparována jeho činnost se skutečným stavem a praxí, prostřednictvím poznatků vytěžených z Výročních zpráv ÚOOÚ. Práce dále přibližuje okolnosti vstupu České republiky do Schengenského prostoru a následně specifikuje ochranu osobních údajů na této úrovni. V rámci Schengenského prostoru se zabývá Schengenským informačním systémem v souvislosti s pojednávaným tématem, tedy s ochranou osobních údajů v mezinárodním kontextu. Poslední kapitola je věnována příslušným pasážím zákona č. 273/2008 Sb., o Policii České republiky a analýze činnosti Policie České republiky z pohledu dodržování ochrany osobních údajů, v mezích zákonných norem, především v souladu se zněním zákona o Policii České republiky.

Abstract:

My diploma work is dealing with a protection of the personal data not only in the standards of the law system and social practice of the Czech Republic, but also on the level of the Schengen Area. At first it is dealing with the defined concept of personal data and further with the characteristics of the tasks and system of work of the Office for the protection of personal data. Further it compares its activity with a real status and practice through the information resulting from the Annual reports of the Office for the protection of the personal data. The work then zooms in the circumstances of the Czech Republic accession to the Schengen Area and subsequently specifies the protection of the personal data on this level. Within the Schengen Area it deals with the Schengen information system in connection with discussed subject, it means with the protection of the personal data in the international context. The last chapter is pursued to the corresponding passages of the Act No. 273/2008 coll.Act, about the Police of the Czech Republic and an analysis of activities of the Police of the Czech Republic from the point of view of the compliance of the protections of the personal data within the law norms, mostly in accordance with the version of the Act about the Police of the Czech Republic.
