Some Social and Legal Aspects of Surrogacy

Abstract:

Diplomová práce se zabývá náhradním (též surogátním, surogačním) mateřstvím a to hlavně jeho sociálními, etickými a právními aspekty, které s institutem souvisí. Teoretická část charakterizuje neplodnost, asistovanou reprodukci a metody s ní související. Dále je osvětlen samotný institut náhradního mateřství a jeho formy, právní úprava v České republice a vybraných státech světa. Nechybí taktéž kapitola zabývající se sociálními a etickými aspekty surogačního mateřství. V praktické části práce jsou představena data z dotazníkového šetření, provedeném na vzorku z veřejností. Je zde prezentován postoj dotazovaných k metodě surogátního mateřství z hlediska etičnosti užití postupu v různých případech, postoj k odměně náhradní matce, legalizaci institutu a jiných. V další výzkumné metodě je představena zkušenost náhradních matek a žen, které o využití institutu uvažují, nebo ho již využily.

Abstract:

This Master Degree Thesis deals with surrogacy and especially its social, ethical and legal aspects related to the Institute. The theoretical part characterizes infertility, assisted reproduction and methods related therewith. Furthermore, there is explained the institute of surrogacy and its forms, legislation in the Czech Republic and some other selected countries. There is also a chapter dealing with social and ethical aspects of surrogacy. In the practical part the data from the survey, conducted on a sample of the general public, are presented. It is presented there the attitude of the respondents to the method in terms of the ethics of using the procedure in various cases, the attitude to remuneration of the surrogate mother, legalization of the Institute and other. In the next research method there is presented experience of surrogate mothers and women who use the Institution.
