Diplomová práce se zabývá problematikou mezinárodních únosů dětí ve světle judikatury Evropského soudu pro lidská práva. Cílem je zodpovědět otázky, zda judikatura ovlivnila rozhodovací praxi českých soudů, záměry zákonodárce v novém občanském zákoníku a také evropské tendence v tomto kodexu pomocí analýzy a komparace judikatury ESLP

This thesis deals with the international child abduction with the respect to the case law of European Court of Human Rights. The aim of this thesis is to answer the questions wether the ECHR case law affects the decision - making practice in the Czech republic, legislature´s intentions in the “New Civil Code” and at least the European trends in “New Civil Code” through analysis and comparsion of ECHR …more
