Environmental Protection with in selected Processes under the Building Law

Abstract:

Disertační práce se zabývá ochranou životního prostředí ve vybraných procesech dle stavebního zákona. Předmětem zájmu je specificky vymezená oblast veřejného stavebního práva, kterou je oblast „užívání staveb“. Cílem disertační práce je provedení analýzy právní úpravy takto vymezené oblasti, doktrinálních názorů a relevantní bohaté judikatury, které se k ní vztahují, a to za účelem vyvození teoreticko-právních závěrů stran dostatečnosti a srozumitelnosti zkoumané oblasti. Analýza by tedy měla posloužit k odhalení „slabých“ míst právní úpravy, a to s ohledem na dostatečnou a účinnou ochranu životního prostředí. Práce odpovídá na dvě základní zkoumané hypotézy, tj. zda lze právní úpravu užívání staveb v rámci veřejného stavebního práva, vnímáno optikou ochrany životního prostředí, označit za vyhovující, a zda jde o právní úpravu jednoznačnou a jednoduchou, tedy srozumitelnou.

Abstract:

The dissertation deals with the environmental protection in specific processes in the virtue of the Building Act. The subject of interest is a specifically defined area of public construction law, which is the area of "use of buildings". The aim of my dissertation is to analyse the legal regulations pertinent to the area defined a accordingly, doctrine-based opinions and relevant abundant case law concerned with the subject matter at hand in order to draw theoretical and legal relevant conclusions regarding the sufficiency and comprehensibility of the researched area. The analysis should therefore serve to facilitate identification of the "weaknesses" in the legislation and legal provisions taking into consideration sufficient and effective environmental protection. This dissertation responds to two fundamental hypothesis examined herein, i.e. whether the legal regulations governing the use of buildings under the public construction law, perceived from the perspective of environmental protection, can be described as satisfactory, and whether the legislation is clear and straightforward, i.e. comprehensible and unambiguous.
