Localization of the UN Convention on the Rights of Persons with Disabilities: case study Czech Republic

Abstract:

Diplomová práce se zabývá přenosem lidskoprávních norem vytvořených na nadnárodní úrovni do vnitrostátního prostředí se zaměřením na Českou republiku a její postoj k Úmluvě OSN o právech osob se zdravotním postižením. Cílem práce je zhodnocení implementace znění mezinárodní smlouvy v českém prostředí. Práce se opírá o teorii lokalizace norem, která směřuje k tomu, aby se vnější normy vzájemně shodovaly s názory a zvyklostmi převládajícími ve vnitrostátním prostředí. Lokalizaci Úmluvy lze analyzovat prostřednictvím ukazatelů vytvořených za účelem zefektivnění vnitrostátní implementace Úmluvy. Diplomová práce využívá ukazatele konkrétně k analýze dodržování článku 27 Úmluvy s názvem Práce a zaměstnávání. Z práce vyplývá, že Česká republika s určitými odchylkami dodržuje nejen článek samotný, ale i znění Úmluvy jako takové, a usiluje tak aktivně o zlepšení života osob se zdravotním postižením. Svůj postoj k dané problematice demonstrovala v roce 2021 přistoupením k Opčnímu protokolu k Úmluvě OSN o právech osob se zdravotním postižením.

Abstract:

The master thesis devotes to the transfer of human rights norms developed at the international level to the national environment, with a focus on the Czech Republic and its attitude towards the UN Convention on the Rights of Persons with Disabilities. The aim of the thesis is to evaluate the implementation of the text of the international treaty in the Czech environment. The thesis is based on the theory of localization of norms, which aims to make external norms coincide with the views and practices prevailing in the national environment. The localization of the Convention can be analysed by means of indicators designed to make the national implementation of the Convention more effective. The thesis uses indicators specifically to analyse compliance with Article 27 of the Convention, entitled Work and Employment. The thesis shows that the Czech Republic, with some deviations, complies not only with the article itself but also with the text of the Convention as such, and thus actively seeks to improve the lives of persons with disabilities. In 2021, the Czech Republic demonstrated its position by acceding to the Optional Protocol to the UN Convention on the Rights of Persons with Disabilities.
