International Judicial Cooperation in Criminal Matters

Abstract:

Mezinárodní justiční spolupráce v trestních věcech je definována hlavně podle mezinárodních smluv, vnitrostátních právních předpisů a mezinárodního obyčeje. První část bakalářské práce popisuje historii a vývoj mezinárodní justiční spolupráce, která vrcholí přijetím Evropského zatýkacího rozkazu (EZR). Největší část práce představuje kapitola 4, která je tomuto EZR věnována společně s řízením, které se na základě této instituce stalo, na rozdíl ve srovnání s tradiční právní pomocí (vydávání-extradice), mnohem rychlejší a jednoduší. EZR je založen na přímých kontaktech mezi justičními orgány. Postup je tak mnohem méně formální a více flexibilní, efektivní a funkční. EZR je prvním právním nástrojem, který je založen na zásadě vzájemného uznávání soudních rozhodnutí mezi členskými státy Evropské unie (EU), jehož prostřednictvím můžeme účinně bojovat proti nadnárodnímu organizovanému zločinu a tím přispět a k udržení a rozvoji EU jako prostoru svobody, bezpečnosti a práva. V páté kapitole se pak věnuji začlenění této mezinárodní spolupráce a Rámcových rozhodnutí do právního řádu České republiky a rozboru platné právní úpravy dané trestním řádem. Mezinárodní spolupráce je uvedena v zákoně č. 141/1961 Sb., o trestním řízení soudním (trestní řád), v hlavě XXV, která je založená na provádění Rámcového rozhodnutí Rady Evropy č. 2002/584/SVV ze dne 13. Června 2002, o evropském zatýkacím rozkazu a postupech předávání mezi jednotlivými členskými státy EU. Cílem této práce je pojednat o vývoji mezinárodní justiční spolupráce v trestních věcech v rámci členských států EU, o dosavadním vyvrcholení této spolupráce v podobě tzv. EZR a s ním souvisejících procesů předávání hledaných osob.

Abstract:

International judicial cooperation in criminal matters is mainly defined by international treaties, national law and international cystom. The first part my bachalor thesis describes history and devepolment of international judical cooperation, which culminates in the adoption European arrest warrant (EAW). The largem section thesis presents charter 4, which is delicated to the EAW, together with management, whitch is based on the institution became the diference in comparisonto traditional legal assistance (extradition), much faster and easier. EAW is based on direkt contacts between judicial authorities. The procedur eis so much less formal and more flexible, effective and operational. EAW is the first legal instrument, which is basde on the principle of mutual recognition of judicial decisions between member states of European union (EU), through which you can effectively vombat transnational organized crime and thus contribute to maintaining and developing EU as an area of freedom, security and justice. In the 5 chapter focuses on the integration of international cooperation and Framework decision in the czech legal system and analysis of current legislativ, the criminal code. International cooperation is given in act no. 141/1961 Coll., the Code of criminal procedure, head XXV based on the implementation of the Council Framework decision from 13th june 2002 2002/584/JHA on the European arrest warrant and surrender procedures between member states of the European union. Objectives of this work is discuss the development of international judicial cooperation in criminal matters in the member states EU, the current culmination of this cooperation in the formo f the EAW and related processes, the transfer of wanted person.
