Abstract:
Diplomová práce pojednává o podjatosti soudců a jejím prokazování v judikatuře Evropského soudu pro lidská práva, Ústavního soudu a českých obecných soudů. Práce nejdříve předkládá teoretické nahlížení na nestrannost soudce. Následně zkoumá judikaturu jednotlivých soudů z pohledu subjektivního a objektivního testu.
Abstract:
Diploma thesis describes the recusal of the judges and searching for the bias in case law of European Court of Human Rights, Constitutional Court and general courts. The first part of the thesis submits the theoretical model of the impartiality of the judges. The second part examines case law of the courts from the point of view of subjective and objective test.
