Abstract:

Předmětem diplomové práce "Soudnictví ve věcech mládeže a některé související sociálně pedagogické aspekty" je deskripce právních, sociálních, výchovných a dalších hledisek soudnictví nad mládeží z teoretického i praktického pohledu. Jejím cílem pak je nejen poměrně zevrubně popsat teoretickou základnu dané problematiky, ale především pokusit se přiblížit otázky vyplývající ze stávající aplikační praxe. Dále pak nastínit možné využití potenciálu sociální pedagogiky se záměrem poukázat na oblasti možného zefektivnění naplňování cílů Zákona o soudnictví ve věcech mládeže při uplatnění sociálně pedagogického přístupu za účelem koncepčnějšího řešení problémů, jež s sebou soudnictví ve věcech mládeže tradičně nese. Práce obsahuje pojednání o historii soudnictví nad mládeží, dále obecný výklad ohledně teoreticko-právních východisek dané problematiky a Probační a mediační službě ČR jako orgánu aplikační praxe. Deskribována je zde oblast výchovných a ochranných opatření ukládaných mladistvým, jakož i opatření trestních, a to včetně jejich dopadu do psychosociální sféry mladistvého. Popsána jsou zde i specifika řízení ve věcech dětí mladších patnácti let. Nechybí ani nástin možného využití sociální pedagogiky a jejích metod při výchovném a preventivním působení na děti a mladistvé v rámci soudnictví nad mládeží. V nespolední radě jsou zde obsažena empirická zjištění ohledně zkušeností osob participujících na řešení trestné činnosti mládeže.

Abstract:

The subject of the thesis "Juvenile justice and Some of the Related Social Pedagogic Aspects" is the description of the legal, social, educational and other aspects of the juvenile justice from the theoretical and practical point of view. The aim of this thesis is not only to describe thoroughly the theoretical basis of this issue, but first of all try to approach the issues arising from the current application experiences. Then to outline the possibility of the potential application of the social pedagogy with the intention to highlight areas for potential streamlining the fulfillment of the Law of Juvenile Justice in applying socio-educational approach for more conceptual resolution of the problems that the juvenile court traditionally carries. The thesis includes essays on the history of juvenile justice, general interpretation regarding the theoretical-legal solutions of this issue and Probation and Mediation Service of the Czech Republic as an institution in application practice. The area of the educational and protective measures imposed to the youth is also described in the thesis as well as the criminal measures including the impact of it in the psycho-social sphere of the youthful. In the thesis is also written about the specific criminal proceedings with the child under fifteen years. There is also outlined the possible use of social pedagogy and its methods in educational and preventive work with children and youthful in juvenile justice. Last but not least, there are contained empirical findings on the experience of participating persons in the solution of juvenile delinquency.
