Liability for Damage Caused by an Occupational Accident or Occupational Disease

Abstract:

Tato práce se zabývá odpovědností zaměstnavatele za škodu způsobenou pracovním úrazem nebo nemocí z povolání. Výsledkem této práce jsou objasnění institutu objektivní odpovědnosti zaměstnavatele a analýza relevantních právních předpisů, odborné literatury a judikatury, za účelem přiblížení rozsahu problematiky zproštění se povinnosti zaměstnavatele nahradit uvedenou škodu či nemajetkovou újmu. V práci je použit kvalitativní výzkum, resp. nenumerické šetření a následná interpretace. Při výzkumu byly využity zejména analýza, syntéza, indukce, analogie a dedukce. Výsledkem výzkumu je popis liberačních důvodů v praxi v závislosti na kvalitě zajištění bezpečnosti a ochrany zdraví při práci (BOZP) v podniku. V poslední kapitole a v závěru práce jsou navržena i možná řešení v reakci na popsaná úskalí zkoumané problematiky.

Abstract:

This thesis deals with liability on the part of the employer for loss or injury caused due to an occupational accident or occupational disease. The result of this thesis is clarification of the institution of objective liability on the part of the employer and analysis of the relevant legislation, professional literature and case law, this being to provide an insight into the scope of the issue of exclusion of the employer’s objective liability to provide compensation for the above-mentioned injury or non-material damage. Qualitative research is used in the thesis, i.e. a non-numerical survey and subsequent interpretation. During the research, use was in particular made of analysis, synthesis, induction, analogy and deduction. The result of the research is a description of the reasons for exclusion of liability in practice in relation to the quality of occupational health and safety (OHS) ensured in the respective enterprise. Proposals are also made in the last chapter and in the conclusion of the thesis for possible solutions in reaction to the pitfalls of the issue under examination which were described.
