Application problems of the Act of the Security Corps Members Services.

Abstract:

Hlavním cílem této diplomové práce je zodpovězení výzkumné otázky: „Je stávající právní úprava služebního poměru příslušníků bezpečnostních sborů způsobilá zajistit efektivní plnění úkolů Policie České republiky?“ Pro splnění tohoto cíle jsem vybral, popsal a rozebral tři oblasti upravené aktuálním zákonem o služebním poměru se zaměřením na jejich možnou „problémovost“ ať již v samotném znění nebo jejich výkladu či aplikaci v praxi. Analytické části práce předchází vymezení základních pojmů tedy Policie ČR a služebního poměru včetně popisu jejich vývoje. V závěrečné části práce jsem zhodnotil jaké dopady problémy, které jsem skutečně zjistil ve všech kategoriích, tedy v samotném znění zákona o služebním poměru, ve znění jej provádějících podzákonných norem i v aplikační praxi, mají, nebo mohou mít, na samotný služební poměr, a zda a v jakém rozsahu a směru ovlivňují efektivitu plnění úkolů Policie České republiky.

Abstract:

The main goal of this thesis is to answer the research question: "Is the current legal regulation of the service of the security corbs members capable of ensuring the effective performance of the tasks of the Police of the Czech Republic?" To meet this goal, I selected, described and analyzed three areas regulated by the current Service Act with a focus on their possible "problematic nature" either in the wording itself or in their interpretation or application in practice. The analytical part of the work is preceded by the definition of basic concepts, thus the Police of the Czech Republic and the service, including a description of their development. In the final part of the work, I evaluated what effects the problems that I actually found in all categories, therefore in the wording of the Service Act itself, in the wording of implementing legislation and application practice, have, or may have, on the service itself, and whether and to what extent and tendency they affect the efficiency of the performance of the tasks of the Police of the Czech Republic.
