VAT impact on business in small and medium-sized enterprises

Abstract:

Annotation PALŠA, Jozef: VAT impact on business in small and medium-sized enterprises. [Diploma thesis]. The College of Banking in Prague, International University Banská Bystrica. Thesis defence: 2015. pp: 80 The diploma thesis deals with the tax effects, namely VAT (Value Added Tax) on small and medium size businesses explaining the issue of unjust “status” of VAT in some cases and its negative influence from the economic point of view in small and medium size businesses. It also proposes and recommends changes in the area, which would support the development of SandMSB. The first chapter is aimed at the theoretical definition and explanation of the issue within the area of the tax policy in the Slovak Republic, as well as the introduction of the basic notions and connections related to the VAT application and its effects on small and medium size businesses. In this chapter, the focus is put on the tax system, tax application and its composition and it also deals with the characteristics of a business, its aims, functions and management. The second chapter deals with the analysis of the current VAT state in SandMSB from the point of view of a selected company, namely the company Kryha, s.r.o., which “benevolent” and unjust VAT application negatively influenced its further functioning and existence in comparison with another company. In this part, the attention is drawn to 3 examples of unjust application of the value added tax, which creates not only an unfair competition but also a legal opportunity of deliberate circumvention of the VAT payments among the small and medium size business on the basis of the current wording of the law and tax law application. The third chapter presents opinions, suggestions and recommendations in the form of changes in application of the current state of the VAT law following the application of the tax laws in the Slovak Republic as a whole.

Anotácia PALŠA, Jozef: Vplyv DPH na podnikanie v malých a stredných podnikoch. [Diplomová práca]. Bankovní institút vysoká škola Praha, zahraničná vysoká škola Banská Bystrica. Katedra financií a bankovníctva. Vedúci práce: doc. Ing. Peter Gallo, CSc. Rok obhajoby: 2015. Počet strán: 80 Diplomová práca sa zaoberá vplyvu daní, konkrétne DPH (daň z pridanej hodnoty) na podnikanie v malých a stredných podnikoch, pričom rozoberá problematiku nespravodlivého „postavenia“ DPH v niektorých prípadoch a následne jej negatívneho vplyvu z ekonomického pohľadu na fungovanie v malých a stredných podnikoch. Zároveň navrhuje a odporúča v tejto oblasti zmeny, ktoré by podporili rozvoj MaSP. Prvá kapitola je zameraná na teoretické vymedzenie a vysvetlenie skúmanej problematiky v oblasti daňovej politiky v SR, ako aj oboznámenie sa so základnými pojmami a súvislosťami, spojenými s uplatňovaním DPH a jej vplyvu na malé a stredné podniky. V tejto časti sa venujeme tak oboznámeniu sa s daňovým systémom, uplatňovaním daní, ich zložením, no taktiež sa v tejto kapitole venujeme aj charakteristike podniku, jeho cieľom, funkciami a riadením. Druhá kapitola sa venuje analýze súčasného stavu DPH v MaSP z pohľadu vybranej spoločnosti, konkrétne spoločnosti Kryha s.r.o., ktorej „benevolentné“ a nespravodlivé uplatňovanie DPH v porovnaní s inou spoločnosťou negatívne ovplyvnilo jej ďalšie fungovanie a existenciu. V tejto časti konkrétnejšie poukazujeme v 3 príkladoch na nespravodlivé uplatňovanie dane z pridanej hodnoty, ktoré vytvárajú medzi malými a strednými podnikmi nie len nekalú konkurenciu, ale aj legálnu možnosť úmyselného obchádzania platenia DPH, na základe súčasného znenia a uplatňovania daňového zákona. Tretia kapitola prináša názory, návrhy a odporúčania v podobe zmien pri uplatňovaní súčasného stavu zákona o DPH, v nadväznosti na uplatňovanie daňových zákonov v SR, ako celku.
