Abstract:

Bakalářská práce se zabývá konceptem materiálního právního státu. Cílem práce je analýza míry uplatnění konceptu materiálního právního státu v právním systému České republiky. Práce je členěna na teoretickou a empirickou část, přičemž v teoretické části je rozebrán význam pojmu právní stát a historický vývoj koncepce právního státu, dále je vymezen vztah mezi koncepcemi Rule of Law a Rechtsstaat, následuje vymezení materiálního a formálního pojetím právního státu. Dále je již přistoupeno k analýze Ústavy České republiky jako deklarace právního státu v materiálním pojetí, jakož i atributů materiálního právního státu, které Ústavní pořádek České republiky vymezuje. V empirické části se práce zabývá kvalitativní a kvantitativní analýzou judikatury Ústavního soudu České republiky spočívající v případovém zkoumání užívání vybraného principu právního státu.

Abstract:

The bachelor thesis deals with the concept of the material legal state. The aim of the thesis is to analyze the level of use of the concept of the material legal state in the legal system of the Czech Republic. The thesis is divided into theoretical and empirical parts, withal the theoretical part discusses the meaning of the concept of the legal state and historical development of the concept of the legal state, followed by the definiton of the relationship between the concepts of Rule of Law and The Rechtsstaat, followed by the definition of the material and formal concept of the legal state. Furthermore, the Constitution order of the Czech Republic is analyzed as a declaration of the legal state in the material conception, as well as of the attributes of the material legal state, that the Constitutional Order of the Czech Republic defines. In the empirical part, the thesis deals with a qualitative and quantitative analysis of the case law of the Constitutional Court of the Czech Republic, consisting in a case study of the application of the principles of the legal state.
