Comparison of social security benefits for LGBTQ families in the Czech Republic and in Belgium

Abstract:

Cílem diplomové práce je komparace dávek sociálního zabezpečení pro duhové rodiny v ČR a v Belgii. V teoretické části práce jsou uvedeny základní pojmy vztahující se ke vzniku a definici duhové rodiny, je popsáno registrované partnerství v ČR a jeho vymezení dle zákona č. 115/2006 Sb., o registrovaném partnerství a o změně některých souvisejících zákonů. Rovněž se teoretická část zabývá právní úpravou týkající se sňatků osob stejného pohlaví v Belgickém království. Další kapitoly vymezují základní pojmy vztahující se k sociálnímu zabezpečení v ČR a v Belgii, jsou popsány struktury a právní úpravy sociálního zabezpečení, které se orientují na české a belgické rodiny s dětmi. V praktické části je provedena komparace těchto dvou systémů se zaměřením na finanční výhody a omezení v rámci sociálních dávek, na které mají homoparentální rodiny v Belgii a v ČR nárok. Součástí praktické části je též primární výzkum v podobě rozhovorů s duhovými rodinami, jehož cílem je identifikovat případné problémy plynoucí z postavení homoparentální rodiny v systému sociálního zabezpečení ČR.

Abstract:

The aim of the thesis is a comparison of social security benefits for rainbow families in the Czech Republic and in Belgium. In the theoretical part of the thesis are presented the basic concepts and definitions related to rainbow families, their formation, as well as the definitions of registered partnership in the Czech Republic according to Act No. 115/2006 Coll., on registered partnership and on the amendment of some related laws. Legal regulations related to same-sex marriages in the Kingdom of Belgium are also presented. Further chapters of the thesis define the basic concepts related to social security for homoparental families with children in the Czech Republic and Belgium and describe the structure and legal regulation of social security in both countries. In the practical part, these two systems are compared, focusing on the financial benefits and restrictions within the framework of social security benefits granted to families in Belgium and the Czech Republic. Part of the practical part is also primary research in the form of interviews with rainbow families with the aim of identifying possible problems resulting from the standing of homoparental families within the social security system of the Czech Republic.
