Criminal Sanctions in the Area of Weapons and Ammunition

Abstract:

Bakalářská práce je zaměřena na trestnou činnost a sankce spojené se zbraněmi a střelivem. Práce je členěna na dvě části. V teoreticko-metodologické části práce jsou představeny základní pojmy jako je trestný čin a jeho skutková podstata, okolnosti vylučující protiprávnost, trestní sankce a pojmy pojící se se zbraněmi a střelivem. Následující kapitola se zaměřuje na právní základ držení zbraní a střeliva, který je vázán směrnicí Evropské unie. V praktické části práce představuji českou a slovenskou právní legislativu nabývání a držení zbraní a střeliva, vymezena je též trestná činnost a sankce na tomto úseku. V závěru práce jsou shrnuty poznatky, kterých jsem dosáhla při svém výzkumu.

Abstract:

Bachelor thesis is focused on crime and sanctions related to weapons and ammunition. The thesis is divided into two parts. In the theoretical and methodological part of the thesis are introduced basic concepts such crime, the nature of the offense, circumstances excluding illegality, criminal sanctions and concepts telated to weapons and ammunition. The following chapter focuses on the legal basis of possession of weapons and ammunition, which is bound by the European Directive. In the practical part I present the Czech and Slovak legal legislation on the acquisition and possession of weapons and ammunition, crime and sanctions in this area are also defined. The conclusion summarizes the findings that I have achieved in my research.
