A Womens Right To Be A Mother? Legal-Philosophical Analysis of the Problem

Abstract:

Diplomová práce se zabývá právem ženy být matkou. Přináší historický výklad vývoje postavení žen a matek, náhled na rozvoj asistované reprodukce, její právní úpravu a nové definice matek. Změnou ve společnosti dochází k narušení významové jednoty matky, z tohoto důvodu dochází ke vzniku nových definic. Cílem práce je zodpovězení otázky, zda je vymezení pojmu matka v právním řádu dostatečné a jestli je nutné ukotvit nové formy mateřství v právu. Tohoto záměru je dosaženo analýzou současných problémů. Součástí práce je návrh na změnu a doplnění právního řádu České republiky.

Abstract:

The diploma thesis deals with the right of a woman to be a mother. It provides a historical explanation of the development of the status of women and mothers, an insight into the development of assisted reproduction, its legal regulation and new definitions of mothers. The change in society disrupts the semantic unity of the mother, for this reason new definitions are created. The aim of the thesis is to answer the question whether the definition of the term mother in the legal system is sufficient and whether it is necessary to anchor new forms of motherhood in law. This goal is achieved by analysing current problems. Part of the work is a proposal to amend the rule of law of the Czech Republic.
