Habitual Residence under the Hague Convention on the Civil Aspects of International Child Abduction

Abstract:

Předmětem této diplomové práce je analýza pojmu "obvyklé bydliště" v režimu Haagské úmluvy o občanskoprávních aspektech mezinárodních únosů dětí. Za tímto účelem je nejdříve přiblížena dotčená úmluva. Dále je pak analyzován pojem obvyklé bydliště, nejprve obecně a poté v režimu úmluvy. Nedílnou součástí práce je také rozbor rozhodnutí soudů, které se zabývaly vymezením předmětného pojmu.

Abstract:

The subject of this thesis is an analysis of the term “habitual residence” on the basis of the Hague Convention on the Civil Aspects of International Child Abduction. To this end, the given convention is first clarified. The term “habitual residence” is analysed first generally and then based on the convention. Another integral part of this work is the analysis of the decisions of the courts which were concerned with defining the concept in question.
