Abstract:

Tato diplomová práce na téma „Mravnostní trestné činy“ sestává ze 4 kapitol, ve kterých autor komplexně zpracovává danou problematiku nejen z pohledu právního, ale využívá taktéž poznatků kriminologie a kriminalistiky s přihlédnutím k faktům sexuologickým. První kapitola sestává z obecné charakteristiky mravnostní trestné činnosti, vymezení základních pojmů, zamyšlení nad možnými příčinami páchání mravnostní kriminality a klasifikace sexuálních trestných činů do tříd. Následující kapitola je věnována vnitrostátním a mezinárodním pramenům práva, které danou oblast upravují. Obsahem třetí kapitoly je rozbor obligatorních znaků jednotlivých mravnostních trestných činů a porovnání nově kodifikované úpravy s předešlou. Podrobněji jsou zpracovány nejčastější trestné činy znásilnění a pohlavní zneužití. V závěrečné kapitole se autor zaměřil na charakteristiku osoby pachatele a oběti mravnostní trestné činnosti v souvislostech kriminologických a kriminalistických a taktéž problematiku viktimizace.

Abstract:

This thesis which deals with the topic of "Moral Crimes" consists of four chapters, in which the author handles the complex issues not only from a legal perspective, but also uses knowledge of criminology and criminalistics with regard to the facts of sexology. The first chapter consists of the general characteristics of the moral crime, the definition of basic terms, analyzes the possible causes of committing a moral crime, and classifies sex offenses into categories. The following chapter is devoted to national and international sources of law that govern the area of legislation. The third chapter provides the analysis of the obligatory characteristic of listed sex crimes and makes comparison of the newly codified laws with previous legislation. The most common crimes of rape and sexual abuse are elaborated in more details. In the final chapter, the author focuses on the characteristics of perpetrators and victims of crime in the moral context of criminological and criminal theory, and also on the issue of victimization.
