Theories of Justice - an Attempt at Typology

Abstract:

Práce se věnuje několika soudobým typologiím teorií spravedlnosti. Kromě jejich zprostředkování, tzn. přiblížení charakteristických (ať už kvalitativních, či kvantitativních) znaků, na jejichž základě jednotliví autoři subsumují dané teorie spravedlnosti do odpovídajících celků, se autor práce pokouší odkrýt i jejich slabiny. S ohledem na ně autor navrhuje svou vlastní typologii, kterou se pokouší následně obhájit, což je hlavním předmětem práce. Součástí obhajoby autorem navrhované typologie je podpůrné využití dějin teorií spravedlnosti, avšak historická analýza má pouze pomocný charakter. Kromě toho je cílem přiblížit nejzávažnější obtíže, které se při konstituování soudobých teorií spravedlnosti vyskytují. Pomocí strukturní analýzy se autor snaží nejen zachytit, jak a proč jsou v jednotlivých teoriích spravedlnosti zdůvodňována kritéria spravedlnosti a celková struktura teorie, ale také jaké jsou potencionálně skryté a zamlčované předpoklady.

Abstract:

The thesis Theories of Justice:an Attempt at Typologies deals with contemporary theories of justice and their typologies. The author acquaints the reader with the typologies of German philosophers, as that of Christop Horn, Nico Scarano, Robert Alexy, Karel-Otto Apel and Hermann Klenner. He controverts the typologies, discloses their weak points and offers a typology of his own. The crucial classification signs of his typology are principles which the individual thinkers use to legitimize their theories of justice. The principles are: sacral, metaphysical and the principle of justification derived from the social reality. The author believes that to legitimize their theories of justice, the thinkers apply one of the above-mentioned principles. He feels the choice of the principle corresponds with fundamental beliefs of that particular thinker. This means that the theories of justice are legitimized in an ad hoc manner.
