Generally Binding Ordinance to Public Order

Abstract:

Tématem diplomové práce jsou obecně závazné vyhlášky obcí o veřejném pořádku. Úvodní část práce se v obecné rovině věnuje samosprávě obcí a zejména jejich pravomoci vydávat obecně závazné vyhlášky. Práce definuje věcný a procesní postup při tvorbě obecně závazných vyhlášek (dále též „OZV“) v rámci zadaného vymezení, analýzu a identifikaci regulovaných oblastí veřejného pořádku a komparace vývoje posuzování zákonnosti vydaných OZV Ústavním soudem ČR. Práce vymezuje, jaká práva a povinnosti k zabezpečení místních záležitostí veřejného pořádku mohou být obcí obecně závaznou vyhláškou stanoveny a za jakých podmínek. Kazuistika vychází zejména z judikatury Ústavního soudu. Součástí práce je věcné vymezení oblastí, které nelze regulovat prostřednictvím obecně závazných vyhlášek.

Abstract:

The topic of the diploma thesis is generally binding decrees of municipalities on public order. The introductory part of the thesis deals remove in general with the self-government of municipalities and especially their power to issue generally binding decrees. The thesis defines the factual and change in the creation of generally binding decrees (hereinafter also "OZV") within the assigned definition, analysis and identification of regulated areas of public order and comparison of the development of legality assessment issued by OZV by the Constitutional Court. The thesis defines what rights and obligations are necessary to ensure local matters of public order can be determined by the municipality by a generally binding decree and under what conditions. The case study is based mainly on the case law of the Constitutional Court. Part of the work is a factual definition of areas that can not be regulated through generally binding decrees.
