Impact of Foreign Criminal Decisions on Criminal Proceedings in the Czech Republic

Abstract:

Extrateritoriální účinky trestních rozhodnutí jsou úzce vázány na problematiku státní suverenity, ta však v posledních letech jakoby ustupuje do pozadí, a to ve prospěch efektivnějšího boje s expandující kriminalitou a účinnější ochrany osob zúčastněných na trestním řízení. Základní vztah k cizím trestním rozhodnutím je v českém právním řádu vymezen v § 21 odst. 3 tr. zák., v němž se stanoví, že trestní rozsudek cizího státu nemůže být vykonán na území republiky ani tu mít jiné účinky, nestanoví-li zákon nebo vyhlášená mezinárodní smlouva, kterou je Česká republika vázána, něco jiného. Při bližším pohledu je pak zřejmé, že s účinkem cizích trestních rozhodnutí je dnes počítáno v řadě mezinárodních smluv, kterými je Česká republika vázána, hned na několika místech trestního řádu a dále pak v zákoně o Rejstříku trestů. Podle platné právní úpravy může pravomocné cizozemské trestní rozhodnutí vytvářet pro tuzemské trestní řízení překážku věci rozhodnuté, a tedy bránit novému trestnímu stíhání téhož obviněného v téže věci, je-li takové trestní rozhodnutí na území České republiky uznáno, může zde být vykonáno a má zde i jiné zákony předvídané účinky, jiné účinky v oblasti tuzemského trestního řízení má cizozemské trestní rozhodnutí také tehdy, pokud je zaznamenáno do evidence Rejstříku trestů (na uznané nebo zaznamenané cizozemské odsouzení se pak hledí jako na odsouzení soudem České republiky), a bez dalšího může mít takové rozhodnutí vždy význam důkazního prostředku.

Abstract:

The exterritorial effects of criminal decisions are closely bound with the matter of the sovereignty of the state that, however have stepped back over the last few years in favour of more efficient struggle with expanding criminality and more efficient protection of persons who are involved in criminal proceedings. The basic relationship to foreign criminal decisions in the Czech legal order is provided for in Sec 21 (3) of the Act No. 140/1961 Coll., as amended, the Criminal Code (hereinafter referred to as the “Criminal Code”) which states that foreign criminal judgment neither can be executed within the territory of the Czech Republic nor shall have other effects, unless the law or the announced international treaty that is binding for the Czech Republic stipulates otherwise. However, after havin closer look at this issue, it is apparent that the effect of foreign criminal decisions is taken into account in a number of international treaties, in the Code of Criminal Procedure and in the Code of the Penal Register. According to the legal regulations in force the effective foreign decisions could create the obstacle to the commencement of the national criminal proceedings (or to prevent continuation of the already initiated proceedings) and therefore preventing the commencement of new criminal prosecution against the same person for the same acts, provided such a criminal decision is recognized within the territory of the Czech Republic, it can be executed and has also other effects anticipated by the law. Foreign criminal decision may also have other effects with respect to the national criminal proceedings in case it is listed in the evidence of the Penal Register (recognized or listed foreign criminal sentences are regarded as the sentences of the courts of the Czech Republic) and ipso jure such a decision may always be important as an item of evidence.
