Damage Prevention in Labour Law

Abstract:

Cílem této diplomové práce je popis systému prevence v pracovním právu. Práce je členěna do čtyř základních kapitol. V úvodu se práce věnuje samotnému pojmu prevence a jeho významu, dále je zmíněna prevence v pracovním právu, její stručný historický vývoj a klasifikace. Následující kapitoly pojednávají o jednotlivých částech a institutech systému prevence, zabývajících se jak předcházení škod na životě a zdraví se zaměřením na vymezení základních pilířů oblasti bezpečnosti a ochrany zdraví při práci, tak ochraně majetku, a to jak zaměstnavatele, tak i zaměstnance. Diplomovou práci uzavírá poslední kapitola věnující se ochraně citlivých údajů zaměstnance. V rámci celé práce je rozebírána právní úprava ve světle související judikatury a jsou zde nastíněny úvahy de lege ferenda.

Abstract:

The aim of the diploma thesis is a description of the system of damage prevention in the labour law. The thesis is divided into four chapters. The introductory chapter deals with the general conception of the prevention and its meaning, the prevention of damage in labour law, its brief history and its classification is also mentioned. Subsequent chapters deal with various parts of a system of prevention and its institutes concerning with different possible ways in order to prevent damage to life and health, with a focus on a defining the basic pillars of safety and health at work, and parts of the protection of employer’s and also employee’s property. The issue about the protection of sensitive data of the employee is situated at the end of the thesis. As part of the work is discussed the legislation in the light of the relevant case law and outlines considerations de lege ferenda.
