Work with perpetrators of domestic violence

Abstract:

Autorka se zaměřuje na sociálně patologický jev domácího násilí, a to konkrétně na práci s pachateli domácího násilí. Domácí násilí je v České republice a nejen v ní, velkým problémem. V teoretické části práce je vysvětlen pojem práva, trestný čin, trestný čin týrání osoby žijící ve společném obydlí, problematika domácího násilí, kde autorka vysvětluje definici domácího násilí, popisuje charakteristiku, druhy, formy, rizikové faktory domácího násilí. Dále se autorka zabývá subjekty domácího násilí, tedy jeho oběťmi a pachateli. V další části se autorka zabývá rolí soudce, kde nejprve vysvětluje pojem soudnictvím, soudce a následně roli soudce. Jsou zde uvedeny právní úpravy týkající se tohoto jevu jako trestného činu, uvedené v trestním zákoníku a možné ukládání trestů. Následně je vysvětlena spolupráce Probační a mediační služby se soudy, probační program, který je možný uložit pachatelům trestných činů. Dále je zde uveden příklad probačního resocializačního programu „Křehká šance“, který realizuje Probační a mediační služba ve spolupráci s Vězeňskou službou České republiky. V závěru teoretické části diplomové práce jsou uvedeny zkušenosti našich sousedů z Německé spolkové republiky s antiagresivními programy, které organizují. Ve výzkumné části se autorka zaměřila na zjištění názoru soudců, jak se dívají na možnost ukládat pachatelům trestného činu týrání osoby žijící ve společné domácnosti podle § 199 trestního zákoníku, absolvovat probační program.

Abstract:

The author focuses on social pathological phenomenon of domestic violence, especially on the work with domestic violence offenders. Domestic violence poses major problem not only in the Czech Republic, but all over the world. In the theoretical part of the thesis is explained the term of law, offence, Offence of abuse of the person living in common dwelling, the issue of domestic violence (where the author explains the definition of domestic violence and describes its characteristics, types, forms, high-risk factors of domestic violence). The author also deals with the victims and offenders of domestic violence. In the next part the author deals with the role of judge. At first she explains the term of judiciary, judge and the role of judge. There are also mentioned legal regulations of the domestic violence as an offence, which can be found in the Criminal Code and the possible sentences. Afterwards is explained cooperation of the Probation and Mediation Service of Czech republic with the courts, probation program, which can be imposed to offenders. There is also given an example of probation resocialization program „Fragile Chance“, which is implemented by the Probation and Mediation Service in cooperation with Prison Service of the Czech Republic. At the end of the theoretical part of the thesis are described the German experiences with anti aggressive programs who organize. In the practical part of the thesis the author focuses on survey among judges, their opinions on the possibility of imposing the obligation to undergo probation program to offenders of the crime of abuse of the person living in common dwelling according to § 199 of the Criminal Code.
