Assets in insolvency proceedings and bankruptcy

Abstract:

Tato práce se zabývá problematikou úpadku v České republice. Jelikož prvního ledna letošního roku vešel v platnost insolvenční zákon, pokusím se komplexně shrnout jeho podstatu, hlavně ve vztahu k podniku jakožto majetku společnosti. V první části uvádím stručnou historii úpadkového práva od středověku do současnosti. Následně je zde charakterizován úpadek a možnosti jeho řešení. Zastavím se zejména u reorganizace - zcela nového institutu českého insolvenčního zákona. Další část mé práce se týká podrobného pojednání o majetkové podstatě, to jest o jejím obsahu, zjišťování a neposlední řadě o jejím případném vynětí či vyloučení. Budu se průběžně zmiňovat o důležitých změnách a srovnávat je s původním zákonem o konkursu a vyrovnání. V závěru upozorním na nedostatky, které se již stihly objevit necelého půl roku po platnosti nového insolvenčního zákona.

Abstract:

The thesis deals with the issue of bankruptcy in Czech Republic. As the new Insolvency Act has been effective since 1st January 2008 I will try to clarify its matter, especially the matter concerning the enterprise as the assets of a company. Primarily I will make a mention of a history of a bankruptcy law from Middle Ages to presence. Later on, I will characterize the bankruptcy and the possibilities of its solution. I will mainly specify the reorganizasion as a brand new possibility of bankruptcy solution lawful in the territory of Czech republic. Another part of my thesis deals with a detailed discourse about the assets, especially about its contents, finding as well as about its potential exclusion. I will also inform about the important changes and compare them to the previous Act on Bankruptcy and Settlements. At the end of my thesis I will advise of shortcomings that have already been discoved less than a half year after the effectiveness of a new Insolvency Act.
