The joint custody as an option post-divorce care for minor children

Abstract:

Diplomová práce pojednává o výchově dětí před a po rozvodu manželství (rozluce partnerství) s nezletilými dětmi se zaměřením na střídavou výchovu. Jedná se o charakteristiku střídavé výchovy v České republice, jakož i o její legislativní oporu. Jsou zde popsány výhody a nevýhody daného rodinného uspořádání včetně dalších možností porozvodové péče o nezletilé děti. Diplomová práce také umožňuje náhled na střídavou výchovu v mezinárodním kontextu s popisem možností střídavé výchovy ve vybraných světových zemích. V rámci opodstatnění střídavé výchovy je uvedena důležitost otcovi role ve výchově dítěte. Teorii doplňují případové studie rodin, kde bylo rozhodnuto popř. je praktikována střídavá péče. Případové studie nabízejí pohled do skutečných příběhů rodičů a dětí a jejich obtížného období spojeného s rozvratem manželství (partnerství) se zaměřením na uplatnění a funkčnost střídavé výchovy v praxi (co rozhodnutí o střídavé výchově předchází a jak v rodinách funguje popř. nefunguje).

Abstract:

The thesis deals with the custody of children before and after divorce (separation partnership) with minor children, focusing on joint custody. These are the characteristics of joint custody in the Czech Republic, as well as its legislative support. They also described the advantages and disadvantages of family arrangements, including the possibility of further post-divorce care for minor children. This thesis also provides a view of joint custody in an international context, describing the possibility of joint custody in selected countries worldwide. The justification for joint custody indicated the importance of the role of fathers in a child upbringing. Theory following case studies of families where it was eventually decided or joint custody is practiced. Case studies offer insight into the true stories of parents and children and their difficult period associated with the disruption of marriage (partnership) with focus on application functionality of joint custody in practice (what preceded by the decision for joint custody and how it in families works or does not work).
