The realization and the benefits of the comunity service work as a criminal sanction

Abstract:

Tématem mé diplomové práce je problematika trestu obecně prospěšné práce. Jde o práci teoretickou založenou na studiu relevantních textových a elektronických dokumentů ke zvolenému tématu. Cílem mé diplomové práce je obecné vymezení role Probační a mediační služby ČR (dále jen PMS) na poli trestní politiky s hlubším zaměřením na trest obecně prospěšné práce, jeho realizaci a na přínos tohoto trestu pro instituci - poskytovatele výkonu trestu, potažmo pro společnost. Ve své práci se zabývám také managementem a organizační strukturou vybrané instituce - poskytovatele výkonu trestu obecně prospěšné práce. V neposlední řadě se ve své práci zmiňuji o konceptu restorativní (obnovující) justice, která mj. také zahrnuje individuální zohlednění potřeb oběti trestného činu a vychází z aktivní role jak obviněného tak oběti. Činnost Probační a mediační služby vychází z tohoto konceptu. Uvádím také základní fakta o PMS, zahrnující poslání, její činnost a principy, na kterých staví odbornou a kvalitní práci úředníků a asistentů s odsouzenými a poškozenými. Neopomíjím ve své práci charakterizovat profesi pracovníka PMS v kontextu sociální práce v systému trestní justice.

Abstract:

The topic of my thesis is the community service sentence. The thesis is theoretical work based on relevant paper and electronic documents that deal with the issue. The aim of the thesis is to generally define the role of the Probation and Mediation Service of the Czech Republic (hereinafter PMS-CR) in the area of the punitive measures with emphases on the community service sentence, its implementation and its benefits for the institution providing the community service sentence, as well as for the whole society. In my thesis I also deal with the topic of management and the organizational structure of the selected institution involved in the execution of the sentence. Last but not least, the thesis mentions a concept of a restorative justice which also includes respect towards individual needs of a crime victim and is based on an active role of both the charged and the victim. The activity of the PMS-CR is based on that concept. I also present essential facts about PMS-CR, including its mission, activities and principles as a base for the professional and high quality work of officials and assistants with the offenders and the injured. In my thesis I did not leave out the specifics of the profession of the PMS-CR worker in the context of a social work in the criminal justice system.
