Abstract:

Tato diplomová práce se zaobírá problematikou právního uznání změny pohlaví a jeho vztahem k ochraně lidských práv. Úvodem je poskytnut výklad pojmu transsexualita, následuje rozbor české právní úpravy změny pohlaví. Podstatnou část práce tvoří rozbor judikatury Evropského soudu pro lidská práva a dalších institucí související s uznáním změnou pohlaví. Dále dochází k posouzení souladnosti české úpravy s lidskými právy a její komparace s právní úpravou vybraných evropských zemí. V závěru práce jsou nastíněny některé oblasti života, ve kterých je na transsexuální osoby zapomínáno.

Abstract:

This diploma thesis deals with an issue of legal gender recognition and its relation to the protection of human rights. The introduction provides a definition of transsexuality, which is followed by an analysis of the Czech regulation of change of gender. A substantial part of the work consists of a study of case law of the European Court of Human Rights and other institutions related to gender recognition. The next part evaluates an existence of harmony between the Czech regulation and human rights law, and compares it with the regulation of selected European countries. The final part foreshadows a few aspects of life that are often forgotten in regards to transsexual persons.
