Criminal liability of a physicians and the process of application

Abstract:

Cílem této diplomové práce je zpracovat téma trestní odpovědnosti lékaře se zaměřením na nejvýznamnější oblasti spojené s jejím uplatňováním. To znamená, že práce se zabývá jak problematikou z oblasti práva hmotného, tak problematikou z oblasti práva procesního. Neznamená to však, že by toto téma bylo zpracováno komplexně a práce obsahovala všechny aspekty s trestní odpovědností lékařů spojené. Práce je členěna do deseti kapitol, které jsou tvořeny dalšími podkapitolami. Čtenář se v práci seznámí s pojmem a druhy právní odpovědnosti. Cílem této části je poskytnout základní informace o tom, co se vlastně institutem právní odpovědnosti rozumí, pojednání o jejím vzniku a stručné seznámení čtenáře se základními druhy právní odpovědnosti. V další části práce se zabývám trestní odpovědností lékaře, která obsahuje pojednání o předpokladech uplatnění trestní odpovědnosti vůči lékaři. Jednotlivé pasáže jsou pro názornost doplněny o příklady ze soudní praxe. Dále se v práci věnuji pojmu "lex artis", který je významným institutem při uplatňování právní odpovědnosti lékaře za provedený zákrok zejména z důvodu mimoprávního původu tohoto pojmu. Stručně je pojednáno také o trestním řízení a obhajobě lékaře. V této části se zabývám zejména volbou vhodného obhájce, jednotlivými stadii trestního řízení a také podmínkami užití tzv. odklonů v trestním řízení. Stranou mé pozornosti nezůstal ani znalecký posudek, který je základním důkazem v trestním řízení proti lékaři, neboť pouze znalec je schopen posoudit, zda lékař postupoval v souladu se současnými poznatky lékařské vědy a jeho závěr je z toho důvodu rozhodující. Konečně v závěru práce jsem nastínil své úvahy o současném stavu legislativy spojené s trestní odpovědností lékaře.

Abstract:

This diploma thesis deals with criminal liability of physicians (doctors) and focuses on the most significant areas connected with its application. It means that this work concerns the issues from the area of substantive law as well as the issues from the areas of procedural law. Nevertheless, that does not mean that the topic is processed comprehensively and the work contains all the aspects connected with the criminal liability of doctors. The thesis is divided into ten chapters, which are composed of other sub-chapters. In this work a reader gets acquainted with the topic of legal responsibility and with all its types. The aim of this part is to provide basic information about the institute of legal responsibility, how it is understood. It deals with its origin and shortly informs the reader about the main types of legal responsibility. The next chapter focuses on the criminal liability of doctors itself. The part contains the disquisition of presumption of exercising the legal responsibility against a doctor. Individual parts are accompanied by cases from judicial practice to illustrate. The following part of my thesis is devoted to the term "lex artis" - a significant institute when exercising the legal responsibility of a doctor for a carried out medical treatment, especially because of the non-legal origin of this term. Criminal proceedings and the defence of doctors are briefly considered. This chapter deals with a choice of a suitable defence counsel, with individual stages of the criminal proceedings and also with the conditions for exercising the diversion in the criminal proceedings. I have taken into consideration the issue of expert's report, which is regarded to be the main evidence in the criminal proceedings against a doctor, as the expert is the only one capable to qualify if the doctor has acted in accordance with contemporary medical findings, and thus the expert's report is decisive. Finally, I have outlined my reflections regarding the recent state of legislation connected with the criminal liability of doctors.
