Misleading commercial practices

Abstract:

Tato bakalářská práce se zabývá klamavými obchodními praktikami. Spotřebitel při svém jednání s dodavatelem či podnikatelem může být ohrožen nekalým jednáním jmenovaných, které vede k poškození spotřebitele. První část mé práce se zabývá teorií. Z textů právních předpisů a knižních zdrojů jsem se blíže podívala na definice základních pojmů a také na možnosti ochrany spotřebitele. Ve druhé, praktické části této bakalářské práce jsem se poté zaměřila na specifické podoby klamání. Jako zdroj informací jsem využila především již vydané rozsudky, ve kterých se soudy zabývaly udělovanými pokutami a žalobami proti nim. Zaměřila jsem se také na výši těchto finančních sankcí. Jednalo se většinou o nízké částky, které nemohly podnikatele od klamání odradit a potrestat. V české judikatuře nalezneme velký počet případů, které se zabývají klamavými obchodními praktikami. Soudy i různé instituce sice kontrolují trh, nicméně výše udělovaných pokut dle mého názoru neplní svůj účel.

Abstract:

This bachelor's thesis deals with misleading commercial practices. Customers dealing with suppliers or businessmen can be deceived by these and can be endangered. The first part of my thesis deals with theory. I took a closer look on legal definitions of basic terms and I also dealt with different ways of customers' protection. In the second part of this work I focused on specific forms of misleading. I used judicial rulings that already exist as a source of information. All of them are about deceivig the customers, fines that have been granted and sues against these fines. I focused on the size of these financial sanctions. They usually were small amounts of money that were not able to discourage and penalize the businessmen. We can find a large amount of cases that deal with misleading commercial activities in the Czech republic. Courts and various institutions do control the market, but in my opinion the size of fines that are granted does not fulfill the purpose.
