Right to a Lawful Judge in Czech Republic

Abstract:

Rigorózní práce se věnuje tématu práva na zákonného soudce jako jedné z procesních záruk spravedlivého procesu, garantovaného v ústavněprávní rovině jak Listinou základních práv a svobod, tak i Úmluvou o ochraně lidských práv a základních svobod a dalšími mezinárodními dokumenty. Je podán přehled judikatury Ústavního soudu České republiky, vztahující se k tématu. Rozpracovány jsou blíže kategorie podjatosti soudce, odnětí a přikázání věci, přísedících, rozvrhu práce a ústavního soudnictví. Pro doplnění zdejšího pojetí doktríny i judikatury je podniknut krátký zahraniční exkurz.

Abstract:

This thesis addresses the issue of the right to a lawful judge, part of the proceedings that guarantee fair trial, a procedure anchored both in the Charter of Fundamental Rights and Basic Freedoms of the Czech Republic and in the Charter of Fundamental Human Rights of the European Union, as well as in other international legal documents. This thesis provides an overview of decisions of the Constitutional Court of the Czech Republic relevant to the right to a lawful judge. Individual chapters examine certain related categories more closely, including impartiality or bias on the part of judges, delegation of the case, lay judges, work schedules and the constitutional judiciary. The work also ventures briefly into matters of doctrine and jurisprudence beyond the Czech borders.
