The recognition and the enforcement of the foreign arbitral awards and the judgments in the EU - comparative study
Abstract:
Cílem této práce je pokusit se srovnat procesy uznání a výkonu soudních rozhodnutí a rozhodčích nálezu v členských státech EU. Předmětem srovnání se v kontextu této problematiky staly dvě stěžejní úpravy, a sice Nařízení Brusel I a Newyorská úmluva o uznání a výkonu cizích rozhodčích nálezů. Srovnávány byly zejména procesy uznání a výkonu a odpírací důvody v obou úpravách.
Abstract:
The aim of this thesis is to analyse and compare procedure of recognition and enforcement of judgments and arbitral awards in the member states of EU. The objects of analysis and comparison were two legal instruments which are on the field of civil and commercial disputes pivotal - the Brussel I Regulation and New York Convention on the recognition and enforcement of foreign arbitral awards.
