The best interest of the child

Abstract:

Diplomová práce analyzuje nejednoznačnost a subjektivitu výkladu pojmu ?nejlepší zájem dítěte? a různé faktory, které ovlivňují jeho vnímání při soudních rozhodnutích o dětech v důsledku rozvodu nebo rozchodu rodičů. Odborníci zapojeni do tohoto rozhodování, ale také rodiče, mají mít stejný cíl, tedy rozhodnout v nejlepším zájmu dítěte. Pokud však obsah tohoto pojmu není zřejmý, je posouzení nejlepšího zájmu dítěte velmi obtížné. V textu předkládáme různá pojetí a výklady ?nejlepšího zájmu dítěte?. Za klíčové je v procesu porozumění a určení nejlepšího zájmu dítěte považováno uspokojování jeho potřeb. Cílem této práce je zjistit, zda má profese vliv na chápání a způsob zjišťování ?nejlepšího zájmu dítěte?, tedy zda odborníci - soudci, psychologové a sociální pracovníci, kladou větší důraz na určitý druh potřeb dítěte při posuzování jeho nejlepšího zájmu. Také nás zajímá, zda má profese vliv na vnímání ohrožení nejlepšího zájmu dítěte v důsledku nedostatku uspokojování základních potřeb, na vnímání významnosti a preference způsobu zjišťování názoru dítěte při posuzování jeho nejlepšího zájmu. Na základě zjištěných údajů výsledky výzkumu komparujeme dle jednotlivých profesí. Práce je přínosem pro zviditelnění možností řešení při hledání nejlepšího zájmu dítěte nejen pro odborníky, ale také pro rodiče.

Abstract:

This master thesis analyses ambiguity and subjectivity of the term ?best interest of a child? interpretation and various factors affecting its perception in divorce/break up legal orders including children. Experts and parents included in order creation should have the same aim, by what is meant the best interest of the child. However, if content of this term is not clear, assessing the best interest is very difficult. In the text, many concepts and interpretations of this term are considered. In the process of understanding and determining child´s best interest, satisfying child´s needs is crucial. The aim of this thesis is to find out if profession affects perception and way of determining ?best interest of the child?, meaning if experts ? judges, psychologists and social workers ? put bigger emphasis on particular kind of child´s need when assessing the best interest. Furthermore, it is desired to know if perception of endangering the best interest of a child as a result of lack of basic needs satisfaction and perception of importance and preferring a certain way of child´s opinion provision when assessing his best interest are affected by profession. Based on acquired data, results of the research are compared according to particular professions. The thesis is a contribution to publicizing solution possibilities of finding the best interest not only for experts, but also parents.
