Práce je rozdělena do pěti hlavních částí, které mají za cíl popsat nepostradatelnost principu nezávislé soudní moci v právním státě. První část práce si klade za cíl objasnit z právně filozofického hlediska vývoj teorie dělby moci.Dále tato část práce obsahuje obecné objasnění hlavních pojmů.
