Abstract:

Diplomová práce se zabývá problematikou trestu obecně prospěšných prací a to z pohledu historického, teoretického a postihuje i praktické problémy spojené se samotným výkonem trestu. První část práce je věnována historickému vývoji tohoto trestu. Druhá část je zaměřena na současnou právní úpravu a je společně se čtvrtou částí, která se věnuje praktickým problémům ukládání a výkonu trestu doplněna judikaturou soudů a úvahami de lege ferenda. Ve třetí části práce jsou popsány některé zahraniční úpravy obdobného trestu.

Abstract:

This thesis deals with the issue of Community Service Sentence from the historical and theoretical perspective, as well as it points out the practical problems connected with enforcement of this sentence. The first part of the thesis is focused on the historical development of this sentence. The second one deals with the current legislation and together with the fourth part, which is about practical problems at sentencing and enforcement, is supplemented by case law and reflections de lege ferenda. There are some descriptions of foreign modifications in the third part of this work.
