Regulation of General Nature as an Administrative Act

Abstract:

Diplomová práce se zabývá opatřením obecné povahy jako jedním z aktů správního práva. Rozebírá opatření obecné povahy jako nástroj práva a současně jako prostředek regulace společenských vztahů. Za použití analýz soudních judikátů a studia odborných stanovisek a literatury práce postupně odhaluje veškerá úskalí opatření obecné povahy jako správního aktu. Rozebírá jeho smíšenou povahu a jeho zvláštní legální definici ve správním řádu. Následně práce zkoumá opatření obecné povahy komparativně jako jeden z aktů správního práva, vedle aktů individuálních a aktů normativních. Paralelně s tímto práce zobrazuje jejich společné průsečíky. Dále práce nabízí náhled na opatření obecné povahy ze strany soudních přezkumů v rámci správního a ústavního soudnictví. V neposlední řadě za účelem naplnění cíle přibližuje konkrétní podobu opatření obecné povahy v právní praxi. Zejména z pohledu uplatnění tohoto zvláštního správního aktu.

Abstract:

This thesis deals with the general nature as one of the acts of administrative law. It discusses general nature as an instrument of law and at the same time as a means of regulating social relations. Using analysis of case law and legal studies expert advice and literature work gradually reveals all the pitfalls of general nature such as administrative act. It analyzes the mixed nature and its specific legal definition in the administrative order. Subsequently, the work examines the general nature comparatively as one of the acts of administrative law, in addition to individual acts and normative acts. In parallel with this work shows their common intersections. The work also provides insight into the general nature on the part of judicial review in the administrative and constitutional justice. Finally, in order to fulfill the objectives of the concrete forms of general nature in legal practice. Especially in terms of applying this special administrative act.
