Legal Regulation of Mass Running Activities with Connection to Environmental Protection

Abstract:

Diplomová práce je snahou o zmapování reakce práva životního prostředí na současný fenomén běžeckého sportu. Od obecného definování běžeckého sportu a jeho pojímání v právu práce plynule přechází k poskytnutí základní orientace v regulaci hromadných běžeckých aktivit dle norem práva životního prostředí. Ústřední kapitoly práce jsou věnovány popisu a analýze konkrétních podmínek pro realizaci hromadných běžeckých aktivit dle vybraných složkových zákonů. Práce se zaměřuje na všechny fáze realizace hromadných běžeckých aktivit a na právní postavení všech osob zúčastněných na těchto aktivitách pasivně či aktivně. V práci je rozebrána i otázka odpovědnosti osob ve sféře správního a občanského práva v rámci konání hromadných běžeckých aktivit. Závěrem jsou v práci uvedeny úvahy hodnotící současný stav právní úpravy a subjektivní názory autorky na vhodný budoucí vývoj regulace.

Abstract:

This thesis examines how environmental law responds to the phenomenon of mass running activities. Starting from a general understanding of running and its conception in law, it then moves to the fundamental orientation in the regulation of mass running activities in environmental law acts. The central chapters of the thesis are devoted to the description and analysis of specific conditions for the implementation of mass running activities stated by the acts protecting individual components of the environment. The thesis focuses on all stages of implementation and on the legal status of all persons participating in these activities passively or actively. As well there is detailed analysis of personal liability in the context of mass running activities provided in the thesis. The author concludes by offering observations on the current status of legal regulation and personal opinions on how regulation should be developed in the future
