Historical roots of contemporary Law of Arms from public aspect

Abstract:

Tato práce pojednává o problematice znakového (erbovního) práva, jeho původu, zdrojích, zvyklostech a zvláště o jeho psané podobě v moderním celoevropském kontextu. Autor se snaží popsat moderní vliv historie jednotlivých evropských států na tamní veřejnoprávní symboliku/heraldiku. Tímto pojmem se rozumí symboly státní, provinční a obecní, především městské, které jako dle autorova názoru jediná část heraldiky (přirozeně doplněné vexilologii – naukou o vlajkách) nesou dodnes právní význam. Autor se nakonec soustředil na Evropu přes několik výjimek – mimoevropských států Commonwealthu. Existují rozdíly mezi klasickým anglo-skotským pojetím Law of Arms (nikoli britským –takové neexistuje) a kontinentálním konceptem, reprezentovaným německým pojmem Wappenrecht. Ani terminologie není shodná. Pokud bychom přeložili výraz Civic Arms do němčiny, vyšel by z toho bürgerliches Wappen, měšťanský znak, tedy něco zcela jiného. Německým ekvivalentem, z něhož autor odvodil český výraz veřejnoprávní znak, je das öffentliche Wappen. Z německého prostředí lze čerpat inspiraci pro získání právního prostředku ochrany znaků před zneužitím, protože v Německu jsou tyto na základě ustálené judikatury chráněny přiměřeným použitím ochrany jména dle § 12 BGB. V některých zemích jsou sice erby jakožto znaky fyzických osob právem uznávány či chráněny, mezi jiným v evropských monarchiích, ale právní relevance či význam takových erbů zůstávají mizivé. V kapitole o anglickém erbovním právu se popisuje poslední známý proces před The High Court of Chivalry (případ město Manchester v. Manchester Palace of Varieties Ltd.) z roku 1954. Nelze opomenout ani instituci úřadů heroldů (heroldie), pokud existují a jejich vývoj, případně jejich novodobé náhrady - rejstříky znaků. Dále se práce zabývá způsoby získání legálního znaku, tedy jak se stát erbovníkem, jak může erbovník znaku používat, jak jej může či nesmí užít třetí osoba, a také jak se dál právo k erbu ztratit. Z moderního pohledu je zajímavé, jak lze užít znaků komerčním způsobem, jaké byly historické předchůdkyně ochranných známek či chráněného označení původu. Všechny tyto otázky jsou zkoumány především s důrazem na subjekty veřejného práva, a to s výslovným opomenutím církevního práva, jehož pravidla zejména v moderní době boří zavedené zvyklosti a jsou dost odlišné. Získat znak se dá dvěma způsoby v závislosti na právním prostředí státu: fyzická či právnická osoba může přijmout (osvojit) svůj znak sama a stát to toleruje či za určitých okolností uzná, nebo je znak udělen z moci státu a osoba může o jeho udělení požádat příslušný státní orgán, ať jím je hlava státu, heraldická autorita, či vláda. Pouze v jediné zemi civilizovaného světa je kompetentním orgánem pro udělení znaku obci nebo kraji předseda parlamentu – je jí Česká republika. Na konci práce autor uvádí tři příklady projevů znakového práva, s nimiž se setkal ve svém bývalém zaměstnání na Ministerstvu vnitra. Žádný z těchto případů nebyl řešen soudně, ale mohou být brány jako důkaz existence erbovního práva v České republice.

Abstract:

This thesis deals with the matter of the Law of Arms, its origins, roots, sources, uses, habits and especially of its written regulations in modern law in European context. The author tried to describe modern consequences of particular European states history and its influence to local Civic Heraldry. The Civic Heraldry, i. e. the symbols of particular state, its provinces and communities, especially of cities, is, in authors opinion, the only part of heraldry (the coat of arms naturally completed with the flag) with real juridical importance. The author in the end focused on Europe with some exceptions, concerning the former British Commonwealth of Nations. There are some differences between classical Anglo/Scottish Law of Arms (but there is nothing like British Law of Arms) and the continental concept of it, represented by German Wappenrecht. Even the terms are not the same. The translation of Civic Arms into German would be das bürgerliches Wappen, which is in fact something completely different: A Burghers or Commoners Coat of Arms, while German equivalent of the term is das öffentliche Wappen or a Public Coat of Arms. From Germany, we could draw the inspiration for one more possible protective measure. In Germany, there are the arms of any person protected from the abuse with the use of the Civil Code (BGB), Art. 12 (A Protection of the Person’s Name). Naturally, there are some countries, where are also private Coat of Arms recognized or even protected by law, among others in the Monarchies of Europe, but the legal relevance or importance of such arms is still marginal. The chapter on English Law of Arms deals very thoroughly with latest process by The High Court of Chivalry (the Case the Manchester Corporation v. Manchester Palace of Varieties Ltd.) from the year1954. Dealing with the matters of heraldry in law, we cannot put out of our sight the intuition of Heralds Offices, where do they exist, and its development. After definition of the object itself, the author describes the ways, how to obtain a legal Coat of Arms, the ways of justified use of a Coat of Arms. Other important questions are what kind of person can obtain a legally protected Coat of Arms (the person of an Armiger)? How could be the Arms or a Crest can be used or abused by a Third Person? What commercial relevance a Coat of Arms could have and last, but not least what are the legal protection means of an Armiger? All these questions the Author researches from the public sphere point of view. It means – how a State (the Government), a City or County (its Council) can protect its symbols from the abuse, from the defamation or from the scorn. There are two ways how to get a Coat of Arms, depending on particular states legal system. A natural or legal person could adopt its Coat of Arms by itself and the State and its Authorities tolerate or recognizing such legal act or a person could apply for granting of an Arms. The Addressee of the application is the competent organ of State, may it be the Head of the State, some kind of Heraldry Authority, or the Government. In just one country of civilized world is the competent organ for granting the arms and flag of Community or of a Province the Chairman of a Parliament. The exception is the Czech Republic. In the end gives the Author three examples of modern Civic Arms cases, which he knows from his former occupation of a Ministry of Internal Affairs civil servant. None of them they put to the Court, as far the author knows, but at least we can take them as a proof Law of Arms existence in the Czech Republic.
