Interrogation of juveniles in policie practice

Abstract:

Diplomová práce se zabývá problematikou výslechu mladistvého, který se řadí v policejní praxi mezi zvlášť zranitelné osoby. Chyby, kterých se vyslýchající může dopustit, zanechávají na dalším psychickém vývoji mladistvého negativní následky. Diplomová práce se zaměřuje na pochopení osobnosti mladistvého z hlediska vývojové psychologie, trestněprávního postavení mladistvého a zvolení správného postupu policejního orgánu v přípravné fázi výslechu a jeho následného provedení. Hlavním cílem práce je definovat nedostatky při jednání orgánu činných v trestním řízení s mladistvými a navrhnout způsoby řešení těchto nedostatků.

Abstract:

The thesis deals with the interrogation of a juvenile, who is a particularly vulnerable person in police practice. The mistakes that the interrogator may commit leave negative consequences on the further psychological development of the juvenile. The thesis focuses on understanding the personality of the juvenile in terms of developmental psychology, the criminal status of the juvenile and the choice of the correct procedure for the police authority in the preparatory phase of the interrogation and its subsequent execution. The main objective of the thesis is to define the shortcomings in the conduct of the law enforcement agency with juveniles and to propose ways of solving these shortcomings.
