Dopady novely zákona o sociálně-právní ochraně dětí na systém náhradní výchovné péče

Abstract:

Předložená diplomová práce pojednává o změnách v systému náhradní výchovné péče, které vznikly vlivem novely zákona č. 359/1999 Sb., o sociálně-právní ochraně dětí, jež nabyla své účinnosti od 1. 1. 2022. V teoretické části se práce zabývá vymezením sociálně právní ochrany dětí a popisem současného systému náhradní výchovné péče u nás. Dále se teoretická část zabývá změnami v již zmiňovaném zákoně a jejich možným dopadem na fungování systému náhradní výchovné péče. Zaměřuje se zejména na problematiku pěstounské péče a zařízení pro děti vyžadující okamžitou pomoc a to proto, že se jich změny výrazně dotýkají. V praktické části bude zpracován kvalitativní výzkum, jehož cílem bude zjistit, jaké pozitivní či negativní dopady přináší uvedené legislativní změny v praxi a jak mohou ovlivňovat životy ohrožených dětí. Sledován bude pohled odborníků z různých institucí pracujících v systému sociálně právní ochrany dětí, se kterými budou realizovány polostrukturované rozhovory.

Abstract:

The thesis deals with the changes in the system of substitute care, which arose due to the amendment to Act No.359/1999 Coll., on social-legal protection of children, which took effect on 1 January 2022. In the theoretical part, the thesis deals with the definition of social-legal protection of children and a description of the current system of substitute care in our country. Furthermore, the theoretical part deals with changes in the aforementioned law and their possible impact on the functioning of the system of substitute care. It focuses in particular on the issue of foster care and facilities for children in need of immediate assistance, as they are significantly affected by the changes. In the practical part, a qualitative research will be prepared, the aim of which will be to find out what positive or negative impacts the above-mentioned legislative changes bring in practice and how they may affect the lives of children at risk. The views of experts from various institutions working in the system of social and legal protection of children will be observed and semi-structured interviews will be conducted with them.
