Abstract:

Tato bakalářská práce se zabývá osobou insolvenčního správce. Nejprve se zaměřuje na obecné náležitosti, které je potřeba splnit, aby se určitá osoba mohla stát insolvenčním správcem, dále na informační povinnost a také na okolnosti, které mohou vést k pozastavení či zániku práva k výkonu činnosti. Poté se zabývá konkrétním případem insolvenčního řízení, kterým je oddlužení. Tato část práce zkoumá jednotlivé povinnosti, které insolvenčnímu správci v oddlužení vznikají a také odměnu, která mu v závislosti na druhu oddlužení náleží. V poslední části se práce věnuje zkrácenému oddlužení a zkoumá možné dopady této novely, která prozatím nebyla projednána.

Abstract:

This bachelor thesis deals with the person of the insolvency administrator. First, the thesis focuses on the general requirements that need to be met in order for a person to become an insolvency administrator, further on information obligation and also on circumstances which may lead to the suspension or termination of the right to pursue the activity. Then it deals with a specific case of insolvency proceeding, which is debt relief. This part of the thesis examines the individual obligations that the insolvency administrator incurs in debt relief and also the remuneration which belongs to him depending on the type of debt relief. In the last part, the thesis deals with shortened debt relief and examines the possible effect of this amendment, which has not yet been discussed.
