Preliminary Rulings in Contentious Proceedings

Abstract:

Tato diplomová práce se zabývá problematikou předběžných opatření v civilním sporném řízení. Je zaměřena zejména na posouzení konformity právní úpravy tohoto institutu s právem na spravedlivý proces. Úvodem jsou definovány základní pojmy a také vymezeny požadavky kladené právem na spravedlivý proces na soudní řízení. Následuje analýza právní úpravy předběžných opatření, která je doplněna o rozbor vybrané judikatury Ústavního soudu a Evropského soudu pro lidská práva. V závěrečné části práce jsou v souladu se zjištěnými nedostatky zkoumané právní úpravy formulovány principy, na kterých by regulace předběžných opatřená měla být založena.

Abstract:

This thesis deals with preliminary measures in civil contentious proceedings. Its aim is to consider the conformity of legal adjustment of the institutute with the right to a fair trial. In the beggining, basic concepts are defined and requirements are posed by the right to a fair trial to proceedings. It is followed by legislation of preliminary measures analysis which is amended by an analysis of selected judisprudence of the Constitutional court and the European Court for the Human Rights. In the end, the principles are defined according to found deficiency of the legislation which was dealt with. These principles should be a basis for the regulation of preliminary measures.
