The Prohibition of Discrimination. An Analyse of the Problem in EU and Czech Republic

Abstract:

Cílem této diplomové práce nazvané „Zákaz diskriminace“ je analyzovat recentní antidiskriminační zákon č. 198/2009 Sb., a odpovědět na následující otázky, především zda bylo nutné přijímat takovouto antidiskriminační právní normu a jaké potíže s vágními, nejasnými legálními definicemi mohou nastat v praxi. Práce samotná je rozdělena do tří částí. První část je věnována definicím základních pojmů vztahujících se k diskriminaci, jako je rovnost, kategorizace, stereotypy, předsudek, pozitivní (nebo afirmativní) opatření a segregace. Ukazuje se, že rozdíl mezi formální a materiální rovností vede k odlišným závěrům. Například zvláštní zacházení poskytnuté určité sociální skupině může být považováno současně jak za porušení principu rovnosti (tudíž v rozporu s formální rovností), tak za pozitivní opatření, které může vyrovnávat ve skutečnosti existující rozdíly nebo handicapy (a tudíž v souladu s materiální rovností). Rozdíl mezi těmito dvěma formami rovnosti je důležitý pro zákonodárce, protože formální rovnost a nediskriminace může být dosažena pouze obecnou právní úpravou, zatímco materiální rovnosti nemůže být právem nikdy zcela dosaženo, neboť afirmativní akce pouze převrací diskriminaci, takže kompenzace mohou být zbytkem společnosti považovány za privilegia. Afirmativní akce pouze přesunuje určité nevýhody z jedné sociální skupiny na druhou. Následující kapitola obsahuje popis diskriminačního mechanismu. Mechanismus může být jako celek považován za právně nepřípustný, neboť vede k segregaci určitých sociálních skupin, avšak jeho jednotlivé části tohoto mechanismu nemohou být jednoduše zakázány právními normami. Jádrem tohoto mechanismu je proces kategorizace ve společnosti, který může negativně označit určitou sociální skupinu. Kategorizace vede ke stereotypům, stereotypy vedou k předsudkům a k nesprávnému chování vůči členům konkrétní sociální skupiny. Stigmatizovaná (označená) sociální skupina je nakonec segregována a znevýhodněna v některých oblastech, jako jsou pracovní nebo životní podmínky, včetně možnosti dosáhnout vyššího vzdělání. Druhá část práce obsahuje detailní popis současného antidiskriminačního zákona č. 198/2009 Sb., včetně pět let trvající legislativní procedury. Zaměřuje se především na nalezení spolehlivých a jasných definic většinou vágních pojmů užívaných zákonodárcem, především na pojmy „přímá“ a „nepřímá“ diskriminace, obtěžování, pronásledování a navádění k diskriminaci. Poté následuje vymezení konkrétních diskriminačních důvodů. Práce poskytuje definice různých diskriminace z důvodu věku, mateřství, pohlaví, pohlavní identifikace atd. Tato část práce extenzivně využívá judikaturu Evropského soudního dvora a judikáty Evropského soudu pro lidská práva, aby byla zajištěna správná interpretace pojmů. Problémem je, že definice dané judikaturou poskytují méně jistoty než zákonné definice, neboť judikatura se neustále vyvíjí. na vybraných případech je prokázáno, jak se měnil přístup soudů k diskriminaci za posledních třicet let. Výsledkem této práce je pak zjištění možných formálních a obsahových nedostatků českého právního řádu. Závěrečná část diplomové práce je zaměřena na praktické problémy související s vynucováním antidiskriminační právní úpravy, především obhajoby v souvislosti s obrácením důkazního břemene a přípustnosti statistik jako jediného důkazu. Případ Denisa Holubová a ostatní proti České republice je názorným příkladem, že výsledky tohoto přístupu mohou být překvapivé a varující. Antidiskriminační zákon č. 198/2009 Sb. není příliš zdařilou právní normou díky nedostatku přesných legálních definic a také kvůli tomu, že se zákonodárce pokusil propojit obě pojetí rovnosti místo toho, aby si vybral jen jedno z nich. Výsledkem této dichotomie je, že si zákonodárce není jistý, jak zabránit diskriminaci ve společnosti - jestli se zaměřit na její příčiny, nebo odstraňovat její následky.

Abstract:

The objective of this diploma thesis named ″The Prohibition of Discrimination″ is to analyze the recent anti-discrimination act no. 198/2009 and to answer the following questions, especially, if it was necessary to adopt such anti-discrimination law and what the difficulties of vague, uncertain legal definitions in reality are. The thesis itself is divided into three parts. The first part is devoted to definition of fundamental terms related to discrimination, such as equality, categorisation, stereotypes, prejudice, positive (or affirmative) action and segregation. It is shown that the difference between the formal and the material equality leads to opposite conclusions. For example, the special treatment enabled to a certain social group can be considered both a legal violation of the equality principle (thus a contradiction to the formal equality) and a positive action, which can compensate the existing difference or handicaps in reality (thus in accordance to the material equality). The difference between these two forms of equality is important for the lawmakers, because only the formal equality and non-discrimination can be achieved by the common legal regulations, whereas the material equality cannot be entirely achieved by the law at all, because the affirmative action only creates reversed discrimination, so the compensations can be considered as privileges by the rest of the society. Affirmative action only redeploys certain disadvantages from one social group to another. The following chapter contains description of the ″mechanism of discrimination″. The mechanism as a whole can be considered legaly impermissible because it leads to segregation of certain social groups, but the parts of this mechanism cannot be simply denied by law. The core of this mechanism is the process of categorisation in society, which may mark a certain social group negatively. Categorisation leads to stereotypes, stereotypes lead to prejudice and to unproper behaviour towards the members of a certain social group. The stigmatized (marked) social group is finally segregated and disadvantaged in certain areas, such as working or living conditions, including possibilities of acquiring a higher education. The second part of the thesis contains a detailed description of the current Czech Anti-discrimination Act no. 198/2009 Coll., including the five-year long legislative procedure. It focuses mainly on finding reliable and clear definitions of mostly vague terms used by the lawmaker, particularly the terms „direct“ and „indirect“ discrimination, harassment, stalking and abeting to discrimination. After that, the particular grounds on which someone can be discriminated are explicated. The thesis provides a definition of various forms of discrimination on the ground of age, maternity, sex, gender etc. In this part of the thesis, the judicature of the European Court of Justice relevant to the discrimination and also the judgments made by the European Court of Human Rights have been used extensively for the correct interpretation of the terms. The problem is that the judicial definitions of the terms provide less confidence than the legal definitions, simply because the judicial is still evolving. It is proven on selected cases that the approach to discrimination has changed during the last thirty years. As a result of the thesis, possible formal and merit drawbacks of the current Czech legal order are found out. The final part of the thesis is focused on the practical problems related to enforcement of the anti-discrimination law, especially the legal defences in connection with the reversed burden of evidence and the admission of statistics as the only proof of evidence. As illustrated on the case of Denisa Holubova and others against the Czech republic, the results of this approach can be surprising and alarming. Anti-discrimination Act no. 198/2009 Coll. is not a very good law due to the lack of precise legal definitions and also due to the fact that the lawmaker attempted to put the two forms of equality together instead of choosing one of them. This dichotomy results in the lawmaker not being sure how to prevent the discrimination in society – whether to aim on its sources or to remove its consequences.
