The Best Interest of the Child in Return Proceedings – Analysis of Legal Regulation and Relevant Case Law

Abstract:

Diplomová práce si klade za cíl analyzovat nejlepší zájem dítěte v řízení o navrácení. První část práce se zabývá analýzou mezinárodní a unijní právní úpravy, s cílem odpovědět na otázku, zda je tato úprava v souladu s principem nejlepšího zájmu dítěte. Zkoumány budou konkrétní ustanovení Haagské úmluvy o občanskoprávních aspektech mezinárodních únosů dětí a nařízení Brusel II ter. Vzhledem ke klíčovému významu judikatury v problematice mezinárodních únosů dětí je v druhé části práce provedena analýza rozhodnutí Evropského soudu pro lidská práva, Soudního dvoru a Ústavního soudu. Jejím cílem je odpovědět na otázku, zda je nejlepší zájem dítěte v řízení o navrácení těmito soudy interpretován v souladu s požadavkem ochrany dítěte.

Abstract:

The thesis aims to analyze the best interest of the child in return proceedings. The first part deals with the analysis of international and EU legislation, with the aim of answering the question of whether this legal regulation is in accordance with the principle of the best interest of the child. The specific provisions of the Hague Convention on Civil As-pects of International Child Abduction and the Brussels II ter Regulation will be examined. Given the key importance of jurisprudence in the issue of international child abductions, the second part of the thesis analyzes the decisions of the European Court of Human Rights, the Court of Justice, and the Constitutional Court. Its aim is to determine whether the best interest of the child in the return proceedings is interpreted in accordance with the requirement of child protection.
