Judicial Administrative Review as a Guarantee of Legality

Abstract:

Abstrakt Tato práce se věnuje úloze správního soudnictví z pohledu ústavně zaručeného práva na soudní ochranu. Vzhledem k tomu, že správní soudnictví náleží do systému záruk zákonnosti, výchozí část práce tvoří teoretický základ definující základní pojmy a instituty potřebné k porozumění tomuto systému jako vzájemně propojenému funkčnímu celku. Těžiště práce pak spočívá v samotném vymezení pojmu správní soudnictví v návaznosti na jeho historický vývoj včetně shrnutí právní úpravy daného tématu. I když bude práce obsahovat větší počet definic či formulací, bude snahou tyto následně uvádět do souvislostí s praxí, a to zejména za přispění judikatury správních soudů, kterou je možné považovat za jeden z nejdůležitějších pramenů této práce.

Abstract:

Abstract This thesis focuses on the role of administrative judiciary from the view of constitutionally guaranteed right to judicial protection. The administrative judiciary belongs to the system of guarantors of legality. The initial part is therefore formed by a theoretical basis defining the basic concepts and institutions, which are needed to understand this interlinked functional system. The focus of the thesis lies in the very definition of administrative justice in relation to its historical development, including a summary of the legislation on the topic. Although the thesis will have a greater number of definitions and formulations , these will subsequently be placed into context with practice , especially with the contribution of the case law of the administrative courts , which can be considered as one of the most important sources of this work .
