Abstract:

Zpracováním diplomové práce s názvem "Státní zastupitelství" bude čtenářům přiblížen vznik, postupný vývoj a role státního zastupitelství, dělení či rozložení práv a povinností instituce v kontextu systému státní moci jak na úrovni zákonné, tak ústavní. Rovněž bude charakterizován porevoluční vývoj státního zastupitelství, organizační struktura nebo místo zasazení státního zastupitelství v právním řádu České republiky. Z pohledu současnosti nebude rovněž opomenuto srovnání státního zastupitelství s institucemi obdobného ražení zakotvených v právní úpravě sousedních zemí, resp. v některých dalších státech evropského kontinentu. V obsahu diplomové práce se rovněž zaměříme na samotnou profesi státního zástupce a její výkon. Jedním z cílů diplomové práce bude současně i představení výkonu profese v rámci trestního řízení. Hlavním záměrem bude zpracovat diplomovou práci, která uceleně a srozumitelně představí instituci státního zastupitelství, státní zástupce jako významné subjekty trestního řízení, jejich postavení jako orgánu činného v trestním řízení a v dále zmíní jejich působení do oblasti práv a povinností adresátů dané právní oblasti. V neposlední řadě budou analyzovány vhodné změny organizačního předpisu soustavy do budoucna.

Abstract:

The diploma thesis "Public prosecution" is concerned with the constitution, development and the role of the Public Prosecutor´s Office. The thesis also deals with the division of rights and the duties of the institution in the context of the state power on two levels - the legal and the constitutional. What will also be characterized throughout the thesis is a process of transformation after the Velvet revolution, the organizational structure and the position of the institution in the legal order of the Czech Republic. From the contemporary perspective, the work will include a comparison of the Public Prosecutor's office with similar institutions that are rooted in the legal orders of some European states. To be more precise, in some of the neighbouring countries of the Czech Republic. A content of the thesis is focused on the prosecutor from two perspectives - firstly, as a profession and secondly, as a performance. One of the aims of the diploma thesis is to introduce the profession in criminal proceedings. The main purpose of the diploma thesis is to create a compact and understandable elaboration of public prosecution as an institution. Furthermore, it describes the public prosecutors as very important subjects of the criminal proceedings and their role as authorities involved in criminal proceedings. What is more, it mentions a province and competences in different areas of law. In addition, a few possible amendments which are important for the Public Prosecutor's Office in the future will be analysed.
