The European arrest warrant and the surrender procedures between Member States EU

Abstract:

I přes počáteční prodlení v délce až 16 měsíců a narušení, které způsobily problémy s ústavami ve více než polovině členských států proběhlo provádění Rámcového rozhodnutí úspěšně. Evropský zatýkací rozkaz funguje ve všech členských státech, a od 1. ledna 2007 funguje i v Bulharsku a Rumunsku. Existuje řada členských států, mezi nimiž je i Česká republika,u nichž Komise shledala řadu nedostatků. V tomto smyslu jsou také navržena doporučení v druhé části této kapitoly. 1 Následující data svědčí o širokém uplatňování evropského zatýkacího rozkazu a ukazují výrazné tendence, které potvrzují jeho efektivitu. Za rok 2005 bylo celkově vydáno okolo 6900 evropských zatýkacích rozkazů, které vydalo 23 členských států. Ve srovnání s rokem 2004 došlo ke zdvojnásobení. Dvacet tři členských států dohromady za rok 2005 obdrželo více než 8500 evropských zatýkacích rozkazů. Ve více než jednom případu ze čtyř vedlo vydání rozkazu k nalezení a zatčení hledané osoby. Z těchto zatčených osob bylo 85 % skutečně předáno, zatímco v roce 2004 to bylo pouze 60 %. Mezi osobami předanými v roce 2005 byla většina z nich předána s jejich souhlasem, zatímco v roce v roce 2004 to byla pouze třetina. Více než pětina osob předaných v roce 2005 měla národnost nebo místo trvalého pobytu členského státu, který souhlasil s jejich vydáním. Lhůty předání činily v průměru 11 dnů, pokud osoba souhlasí (15 dnů v roce 2004), 5 týdnů v případě, že osoba nesouhlasí (45 dnů v roce 2004), 5% předání překročilo maximální lhůtu 90 dnů. 2 Data pro statistiku za rok 2006 byla zatím zpracována pouze za 14 členských států na rozdíl od roku 2005, kdy byla statistika zpracována za 23 členských států. Podle této statistiky bylo za rok 2006 vydáno okolo 5832 evropských zatýkacích rozkazů, které vydalo celkem 14 členských zemí. Bylo předáno 1456 osob. Mezi osobami předanými v roce 2006 byla většina z nich předána s jejich souhlasem (konkrétně 51 %), 29 % osob předaných v roce 2006 mělo národnost nebo místo trvalého pobytu v členské zemi, která souhlasila s jejich předáním. Došlo ke značnému zkrácení lhůt předání (pět týdnů v případě nesouhlasu).3 Zpráva Komise o provádění rámcového rozhodnutí Rady ze dne 13. června 2002 o evropském zatýkacím rozkazu a postupech předávání mezi členskými státy od roku 2005 ze dne 11. 7. 2007 vytýká České republice některé nedostatky v provádění evropského zatýkacího rozkazu, jako je zavedení lhůty při uplatňování čl, 4, odst. 6 Rámcového rozhodnutí, konverze uloženého trestu za trestný čin spáchaný státními příslušníky daného státu v jiném členském státě a chybějící maximální lhůta pro vydání rozhodnutí nejvyšších soudů. Komise vytýkala České republice také, že vyžaduje dodatečné záznamy a podklady, které nejsou uvedeny ve formuláři podle čl. 8 odst. 1 Rámcového rozhodnutí. Česká republika informovala Komisi, že tento nedostatek byl odstraněn oběžníkem ministerstva spravedlnosti ze dne 19. května 2006, který uvádí, že formulář používaný pro vydávání evropského zatýkacího rozkazu odpovídá tomu, který je obsažen v Rámcovém rozhodnutí, přičemž oběžník je právní nástroj českého práva. Navíc mohou české soudní orgány požádat o doplňující informace, pouze pokud jednají jako vydávající orgány. Závěrem lze konstatovat, že i přes některé dílčí problémy a nedostatky se podařilo začlenit ustanovení o evropském zatýkacím rozkazu do legislativy České republiky i všech ostatních členských zemí, a že jeho využívání se stává stále častějším a efektivnějším. Česká republika však musí i nadále zpracovávat připomínky Komise a odstraňovat nedostatky.

Abstract:

The Framework Decision has been implemented successfully despite the early delay of 16 months and the disturbances due to problems caused by contradictions embedded in more than one half of Member States Constitutions. The European Arrest Warrant works in all Member States and starting from 1st January 2007 in Bulgaria and Romania, as well. There are quite a number of countries in the EU, including the Czech Republic, which should devote much more effort to comply fully with all requirements defined by the Framework Decision. Accordingly, the recommendations are designed at the thesis. Following data give evidence of broad application of European Arrest Warrant and show significant tendencies confirming its effectiveness. About 6900 European Arrest Warrants were issued in 2005, which were issued by 23 Member States. This means doubling in comparison with 2004. In 2005 twenty three Member States received totally more than 8500 European Arrest Warrants. In more than one in four cases the issue lead to an arrest of wanted person. Eighty five per cent of the arrested persons were surrendered in 2005, while in 2004 only sixty per cent of arrested persons were surrendered. Majority of these surrendered people was surrendered with their consent, while in 2004 this number equalled only to one third. More than one fifth of persons surrendered in 2005 were of a nationality or residency in a Member State, which agreed with their surrender. Terms of surrender averaged 11 days in case of person?s consent in 2005 (while 15 days in 2004) and 5 weeks in case of non consent in 2005 (while 45 days in 2004). Only 5 per cent of terms exceed the maximum limit of 90 days. The statistic report for 2006 has not been completed yet, data have gained from 14 Member Stated only, in comparison to the 2005 statistic when 23 states? data were processed. According to the aforesaid statistic in 2006 about 5832 European Arrest Warrants were issued by 14 Member States. In 2006 1456 persons were surrendered. Majority of these persons surrendered in 2006 were surrendered with their consent, 51 per cent in particular. Twenty nine per cent of persons surrendered in 2006 were of nationality or residents in the Member State, which agreed with their surrender. Significant shortening of terms occurred in 2006. (5 weeks in case of non consent). The Report of Commission on Implementation of Framework Decision on European Arrest Warrant and Surrender Procedures between the Member States of 13th June 2002 covering the period from 2005 dated 11th July 2007 criticises the Czech Republic for some negatives while applying the European Arrest Warrant, such as introduction of the term concerning the execution of the exercise of Article 4, paragraph 6 of the Framework Decision, conversion of sentence imposed on residents of given state for crime committees in another state and absent maximum time-term for rendering decisions by supreme courts. Commission commented another fault of the Czech Republic. In the Commission?s opinion, the Czech Republic required additional notes and materials that are not contained in the form according to Article 8, paragraph 1 of the Framework Decision. The Czech Republic informed the Commission that this fault had been corrected by the mean of a circular of the Ministry of Justice of 19th May, which states that the form used for the European Arrest Warrant issue complies with the one defined by the Framework Decision and that it is a legal institute of Czech law, as well. Moreover, the judicial authorities may ask for additional information only if playing the role of a surrendering authority. Finally, it can be declared, even despite of some partial faults and problems, that the institution of the European Arrest Warrant has been successfully integrated into the legislature of all Member States and that its application has become more frequent and effective.
